This commitment was not exist before charter of the United Nations, where states were free to settle their disputes by military force.

In accordance with Chapter VI of the Charter of the United Nations entitled "The pacific settlement of disputes", In Article 33, the first paragraph, acknowledged the following: "All parties to any dispute whose continuation would endanger the maintenance of international peace and security must, first of all, seek its solution through negotiation, investigation, mediation, conciliation, arbitration and judicial settlement, or by resorting to regional agencies and organizations or other peaceful means of their choice.".
